Important Order Issued For Private Schools in Jammu and Kashmir

Amidst the ongoing admission season for the upcoming academic session in Jammu and Kashmir, a surge of complaints has reached the Committee for Fixation and Regulation of Fee of Private Schools (FFRC). Allegations highlight private schools charging admission fees in clear violation of established statutes.

Sources reveal that a considerable number of these schools are reportedly accepting payments in cash without issuing proper receipts. The situation has prompted action from the Committee, chaired by Justice Sunil Hali.

Section 20E (1) of the Jammu and Kashmir School Education Act 2002, amended over time, explicitly outlines the permissible fees private schools can levy.

The statute prohibits schools from charging any fee, including admission fees, beyond tuition fees, annual fees, transport fees, and voluntary special-purpose fees approved by the FFRC.

In response to these concerns, the FFRC has issued a circular (Circular No: OFFRC of 2023) with specific instructions to private schools across Jammu and Kashmir:

1. Strict adherence to the statute: Private schools are reminded not to charge admission fees in violation of established regulations.

2. Collective responsibility: If proven, a complaint against a school for charging admission fees will be deemed applicable to all admitted students. Legal actions will be taken against the school management.

3. Accountability through investigation: In case of denial or lack of receipt by a school, the matter will be referred to the Central Bureau of Investigation (CBI) for a thorough inquiry. Adverse reports may lead to legal consequences, including de-recognition or dis-affiliation.

Justice Sunil Hali, Chairperson of the Committee for Fixation and Regulation of Fee of Private Schools, emphasized the importance of upholding statutory regulations to ensure fair and transparent fee structures across private educational institutions in Jammu and Kashmir. Schools found in violation of these guidelines may face significant repercussions.
